These terms explain the rules for using Kae. Please read them, especially sections 3, 4, 14 and 15, which limit what Kae is for and what we are responsible for.

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Khalid Hadadi, the independent developer of Kae, based in the Kingdom of Saudi Arabia ("we", "us"). They cover the Kae app for iPhone and Apple Watch, its widgets, the website kaeapp.com, and any related services (together, "Kae").

By downloading, accessing or using Kae, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Kae.

2. Who can use Kae

• You must be at least 16 years old.
• You must be able to form a binding agreement where you live, and not be barred from using Kae by any applicable law.
• Kae is for personal, non-commercial use.

3. Kae is not medical advice

• Talk to a qualified doctor or dietitian before starting a diet, changing how you eat, or setting weight goals, especially if you have a health condition, are pregnant or breastfeeding, or take medication.
• Do not use Kae to make medical decisions, including dosing insulin or other medicine, or managing diabetes, kidney disease, allergies, an eating disorder or any diet prescribed by a clinician.
• Food sensitivity warnings in Kae are a convenience only. Always read the product label and ask the restaurant. Never rely on Kae to avoid an allergen.
• Calorie and nutrient goals are general estimates and may not suit you.
• If food tracking makes you feel anxious or you notice unhealthy patterns, stop using Kae and seek help from a professional.
• In a medical emergency, call your local emergency number (997 in Saudi Arabia).

You use Kae, and act on anything it shows you, at your own discretion and risk.

4. Estimates and AI

Kae works out nutrition from product labels, public food databases, restaurant information, recipes, community entries and artificial intelligence. All of these can be wrong or out of date, and portions are often approximate. So:

• Every number in Kae is an estimate. We do not guarantee that any calorie, nutrient, ingredient, allergen or source information is accurate, complete or current.
• AI can misread text, photos and labels, and can produce results that look confident but are wrong. Check results that matter to you, and correct or report them.
• Restaurant and product names belong to their owners. Their appearance in Kae does not mean they endorse Kae or have checked its numbers.

5. Your account

• You sign in with Apple or Google. Give accurate information and keep it up to date.
• Keep your devices and sign-in secure. You are responsible for activity under your account.
• Tell us right away if you think someone else is using your account.
• One person per account. Accounts cannot be sold or transferred.

6. Subscriptions and payment

• Plans. Kae Pro is an auto-renewing subscription, monthly or yearly. Prices are shown in the App Store in your local currency, including any taxes, before you buy.
• Free trial. Eligible new subscribers get a 3-day free trial. Unless you cancel at least 24 hours before it ends, it converts into the paid plan you chose and you are charged. Trial eligibility is decided by Apple and by us, and is limited to one per person.
• Billing and renewal. Payment is charged to your Apple account when you confirm the purchase and at the start of each renewal period. Your subscription renews automatically unless you turn off auto-renew at least 24 hours before the current period ends.
• Cancelling. Manage or cancel in iPhone Settings → your name → Subscriptions. Cancelling stops the next renewal; you keep access until the end of the period you paid for. Deleting the app or your account does not cancel a subscription.
• Refunds. All payments are processed by Apple. We cannot issue refunds directly. You may request one from Apple at reportaproblem.apple.com, under Apple's policies. Except where required by law, payments are non-refundable and there are no partial refunds.
• Price and feature changes. We may change prices and what each plan includes. Price changes apply from your next renewal, and Apple will notify you and ask for your consent where required.
• Fair use limits. AI features have usage limits to keep Kae sustainable. Normal personal use stays well within them. If use looks automated or abusive, we may slow or pause AI features for that account.

7. Your license

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use Kae on Apple devices you own or control, for your own non-commercial use, as permitted by Apple's Usage Rules. All rights not expressly granted are reserved.

8. Acceptable use

You agree not to:

• Copy, modify, sell, rent, sublicense or redistribute Kae, or build a competing product from it.
• Reverse-engineer, decompile or try to extract Kae's source code, models, prompts or data, except where the law allows it.
• Scrape, crawl or bulk-download Kae's food data or results, or access Kae through automated means.
• Interfere with, overload or try to break Kae's security or servers.
• Create multiple accounts to get extra free trials or avoid limits.
• Upload anything illegal, harmful, hateful, sexual, misleading, or that infringes someone else's rights, including photos of other people without permission.
• Use Kae in a way that breaks any law or Apple's App Store rules.

9. Your content

• What you log (text, photos, notes, reports) stays yours.
• You give us a worldwide, royalty-free license to host, store, copy, process and display your content only as needed to run, maintain and improve Kae, as described in the Privacy Policy. This license ends when you delete the content or your account, except for nutrition facts that contain no personal data, and community foods as described below.
• You confirm you have the right to upload what you send.
• If you send us feedback or ideas, we may use them freely, without paying or crediting you.

10. Community foods

• If you choose "Add to community", that food entry becomes visible to other Kae users, marked as community-contributed and unverified, without your name.
• You give us a perpetual, worldwide, royalty-free license to use, edit, display and share that entry within Kae.
• Please share only accurate entries. Community entries are not checked by us before they appear, and we are not responsible for them.
• We may edit, hide or remove any entry, and limit the sharing of users who break these Terms. You can report entries and block contributors.

11. Third-party services and data

• Kae works with services we don't control, such as Apple Health, Sign in with Apple, Google Sign-In and the App Store. Their own terms and privacy policies apply to your use of them.
• Kae uses public and third-party food data, including data from the U.S. Department of Agriculture (USDA), the Saudi Food and Drug Authority (SFDA) and Open Food Facts. Some product data is © Open Food Facts contributors and available under the Open Database License (ODbL).
• Links to other websites are for convenience. We are not responsible for their content or practices.

12. Our property

Kae, including its name, logo, design, code, text, graphics and the compiled food data we create, belongs to us or our licensors and is protected by intellectual property laws. These Terms give you no ownership of, or right to use, the Kae name or logo.

13. Changes to Kae and availability

• We may add, change or remove features at any time, including features marked as beta or experimental, which may be less reliable.
• Kae needs an internet connection for most features. It may sometimes be unavailable because of maintenance, outages, or problems with our providers.
• We may stop offering Kae. If we do, we will try to give reasonable notice and a way to request your data.

14. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY LAW, KAE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, QUIET ENJOYMENT AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT KAE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT ANY RESULT, NUMBER OR INFORMATION WILL BE ACCURATE OR RELIABLE, OR THAT USING KAE WILL HELP YOU REACH ANY HEALTH OR WEIGHT GOAL.

15. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

• WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL.
• WE WILL NOT BE LIABLE FOR ANY INJURY, ILLNESS, ALLERGIC REACTION, HEALTH OUTCOME, OR WEIGHT CHANGE, OR FOR ANY DECISION YOU MAKE, BASED ON INFORMATION OR ESTIMATES IN KAE, INCLUDING COMMUNITY ENTRIES AND AI RESULTS.
• OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO KAE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR KAE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 50.

These limits apply to any theory of liability, even if we were told the damage was possible. Some laws do not allow certain limits, so some of these may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, such as for fraud or wilful misconduct.

16. Indemnity

To the extent permitted by law, you agree to defend and indemnify us against claims, losses and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of Kae, or content you upload or share.

17. Ending these Terms

• You can stop using Kae and delete your account at any time in Settings.
• We may suspend or close your account, without refund where the law allows, if you break these Terms, misuse Kae, or if we are required to by law.
• Sections 3, 4, 9 (feedback), 10, 12, 14, 15, 16, 18 and 20 continue after these Terms end.

18. Governing law and disputes

These Terms are governed by the laws of the Kingdom of Saudi Arabia. Before starting any formal dispute, please email us so we can try to resolve it informally within 30 days. If it can't be resolved, the competent courts in the Kingdom of Saudi Arabia have exclusive jurisdiction. If you are a consumer, this does not take away any mandatory protections given to you by the law of the country where you live.

19. Apple

If you downloaded Kae from the App Store:

• These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for Kae and its content.
• Your license is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support for Kae.
• If Kae fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding Kae.
• We, not Apple, are responsible for addressing any claims relating to Kae, including product liability claims, claims that Kae fails to meet legal or regulatory requirements, and consumer protection or similar claims.
• If a third party claims that Kae infringes its intellectual property, we, not Apple, are responsible for investigating, defending, settling and discharging the claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and that you are not on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using Kae.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

20. General

• Changes. We may update these Terms. We will change the effective date and let you know about significant changes in the app or by email. If you keep using Kae after changes take effect, you accept them. If you don't, stop using Kae.
• Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about Kae.
• Severability. If any part is found unenforceable, the rest stays in effect.
• No waiver. Not enforcing a right now doesn't mean we give it up.
• Assignment. You may not transfer these Terms. We may transfer them, for example if Kae is sold, and your rights stay the same.
• Events beyond control. We are not responsible for delays or failures caused by events outside our reasonable control.
• Language. These Terms are available in Arabic and English. If they differ, the Arabic version prevails for users in Saudi Arabia, and the English version for everyone else.
